KMC Mayor Shah suggests Constitution amendment to authorize SC for “map approval”

KATHMANDU: Mayor of Kathmandu Metropolitan City (KMC) Balen Shah has suggested that the Supreme Court (SC) be given the authority to “approve structure map”.
His comments on social media come soon after the SC issued an interlocutory order to not remove the structures set up by the Norvic Hospital on public land.
A single bench of Justice Manoj Kumar Sharma issued the order against the directive of Kathmandu Metropolitan City (KMC) to remove the hospital structures within 24 hours.
Spokesperson at Supreme Court, Bimal Poudel, has said the SC had issued interlocutory order to not demolish the structures within coming Monday.
On coming Monday, there will be a next hearing on whether the hospital would be obliged to demolish the structures built without the map approval on public land.
A written response including the reason why the hospital had to demolish the structure has been sought by the SC.
Mayor Balendra Shah himself had come to hand the notice, urging Norvic Hospital to remove its structures on the public land. In the notice, he had argued that Norvic Hospital raised the structures as canteen in the public land with plot number 2,085 (area 1-8-1-1), which is against the contract with Nepal government.
Moreover, it was established without map approval and building code. The hospital had filed a writ petition at SC against KMC directive order on Tuesday.
Last Monday, the KMC has instructed the hospital to remove the structure within 24 hours saying that it had built an ‘illegal’ structure.
Against this, a bench of Justice Manoj Kumar Sharma issued a short-term order not to implement KMC’s ultimatum.
After the SC’s order, Kathmandu Mayor Shah wrote a comment on his Facebook.
In his comment, he suggested the concerned authority to amend the Constitution to give the right to endorse the map to the Supreme Court.
